“A RESOLUTION CALLING FOR AMENDMENT OF
SECTION VI “FARE MATRIX” OF ORDINANCE NO. 3, S. 2000”
WHEREAS, due to the soaring price of gasoline in our country today, the transport sectors are appealing for fare increase in order for them to cope up with the situation;
WHEREAS, “skylab” operators and drivers in Upi have filed their petition for fare increase to this August Body;
WHEREAS, to facilitate the appeal of the mentioned group, the Committee on Transportation and Communication conducted consultations through public hearings and positive response from the riding public was attained;
NOW THEREFORE, considering the request proper and in order, on motion of Hon. Alexis M. Platon duly seconded by the majority it was;

“AN ORDINANCE AMENDING SECTION VI “FARE MATRIX”
OF ORDINANCE NO. 3, S. 2000
Be it ordained by the Honorable Sangguniang Bayan of Upi, Maguindanao;
Section I. TITLE – This shall be known as the ordinance prescribing the regulation and operation of the “skylab” (Motorcycle-for hire) in the Municipality of Upi, Maguindanao.
Section II. PURPOSE AND SCOPE – The purpose of this is to regulate the operation and fare rates of the “skylab” (Motorcycle of hire) in the jurisdiction of the Municipality of Upi, Maguindanao complying with all the rules and regulations provided which will partially solve the transportation problem in most Barangay especially in the remote areas.
This will answer the clamor of the riding public which is of great help to them.
Section III. APPLICATION – This ordinance shall apply to all persons, permanently residing in the Municipality of Upi, Maguindanao, with motorcycle duly registered with the Land Transportation Office and has complied with all the requirements, rules and regulations governing the operation of skylab within the Municipality of Upi.
Section IV. DEFINITION OF TERMS:
a) OPERATOR – the owner of the motorcycle duly registered with the LTO and issued with the Mayor’s permit to operate.
b) DRIVER – the one who drives the motorcycle and a driver license holder. He is the substitute of the operator.
c) SKYLAB – the motorcycle for hire used to transport passengers and goods to a given destination.
Section V. REQUIREMENTS FOR PERMIT TO OPERATE SKYLAB AND SCHEDULE OF FEES
a. Three (3) copies of Certificate of Registration (CR) and current Official Receipt (O.R.)
b. Three (3) copies of picture of the unit (5R).
c. Three (3) Xerox copies of Barangay Clearance.
d. Three (3) Xerox copies Residence Certificate.
e. Three (3) Xerox copies of Police Clearance.
f. Three (3) Xerox copies of Professional Drivers License.
g. Three (3) Xerox copies of Insurance Certificate of Cover such as TPL, PD and Personal Accident and the three unnamed riders.
h. Three (3) Xerox copies of Official Receipt (O.R) as payment of the following fees:
a. Mayor’s Permit P 300.00
b. Inspection Fee 30.00
c. Local Research Fund 20.00
d. Plate (to be provided by MTO) 60.00

Note: The fare matrix was computed based on the following rate of discount for every additional passenger up to maximum of 3.

The student will enjoy their 50% discount privilege while the Senior Citizen 20% discount will be built-in in the fare matrix.
Section VII. OPERATING CONDITIONS:
1. For safety reasons; no “SKYLAB” shall operate without proper crash-guard and carrier installed in the unit.
2. No. “SKYLAB” are allowed to operate without first securing Permit to Operate from Local Government Unit. An operator to stop service completely or to suspend service for more than one month should report in writing such termination to the Mayor’s Office.
3. For easy identification, the unit shall bear a number assigned by the Municipal Treasurer’s Office printed boldly at the rear with the dimension of four by six (4x6) color of which is green with white lettering.
4. Personal Accident Insurance of driver and the three (3) riders should be no less than P 40,000.00. An applicant should submit a waiver of his unit, duly signed in favor of the LGU who shall dispose of the same in case of unsettled obligation.
5. The grantee should be the rightful owner of the unit stipulated in the Certificate Registration (CR), Official Receipt (OR) and shall operate his own unit with substitute (driver).
6. No “SKYLAB” shall be allowed to carry more than three (3) passenger or goods equivalent to three (3) passengers. Racing with other vehicles or other forms reckless driving is strictly prohibited, speed limit of 20 kph (loaded or unloaded) within the Poblacion. No dilapidated and unfit units are allowed to operate.
7. No. “SKYLAB” shall operate on zone with existing motor tricycle-operators permit (MTOP) holder.
8. Permit to operate is non-transferable.
9. Operator/driver, should properly with rubber boots (should not wear sleeveless clothes, short pants and slippers).
Section VIII. PROHIBITION WITH CORRESPONDING PENALTIES
- Operating/driver without permit to operate P 500.00

Section IX. IMPLEMENTATION. The Philippine National Police (PNP) and the deputized government official concerned are hereby enjoined and requested to strictly observe the proper enforcement and implementation of this Ordinance.
Section X. SAVING CLAUSE. Subject to the provisions of the Local Government Code of the Autonomous Region in Muslim Mindanao and consistent with any future legislation and/or court decisions, - the Sangguniang Bayan reserve the right to pass and/or enact-legislation to enforce the real intention of this Ordinance.
Section XI. SEPARABILITY CLAUSE. If for any reason or reasons, any fact or provisions of the Ordinance shall be held unconstitutional or invalid, the other parts or provisions hereof which are not affected thereby, shall continued to be in full force and effect.
Section XII. AMENDMENTS. This Ordinance shall be amended by 2/3 or majority votes of the Sangguniang Bayan.
Section XIII. EFFECTIVITY CLAUSE. The Ordinance shall take effect upon approval.
